Some mentalboutmax.com Services are available to you free of charge, while others require that you create a User Account through our E Commerce Shop and pay a Purchase Fee to Download and Access our Training Materials.

Access to and use of the Services, whether accessed with or without payment are subject to the terms and conditions of this Agreement.

By accessing the Services or creating a User Account, you also agree to the provisions of the mentalboutmax.com Privacy Policy, available at www.mentalboutmax.biz/pagehtml/privacy.html

This Agreement and Privacy Policy include important legal information, including the exclusion of certain warranties and remedies.

You are responsible for reviewing this Agreement and the Privacy Policy.

Modification of Terms

Mentalboutmax reserves the right to modify these Terms at any time. Except as otherwise stated herein, any change to these Terms is effective immediately after posting on mentalboutmax.com. Users agrees to check the Site periodically for changes to these Terms. Any use of the Site after changes have been made shall be deemed acceptance of those changed terms and/or conditions.

Accounts

In order to obtain access to ’Paid For’ Services, you must create a mentalboutmax.com account (“User Account”) and pay the appropriate fees for access to the services you request.

By creating a User Account, you represent and warrant the information you provide is accurate and complete.

You may never use another's account or share your User Account with others.

For example, an institution may not purchase Training Materials and share those Training Materials among multiple employees.

You are responsible for maintaining the security of your password and are solely responsible for the activity that occurs on your User Account.

If you believe your User Account has been breached or used in any unauthorized manner, you must notify a mentalboutmax representative immediately. Mentalboutmax is not responsible for any damage or losses caused by unauthorized use of your User Account. You, however, may be responsible to mentalboutmax for any harm mentalboutmax.com incurs due to unauthorized use of your mentalboutmax.com User Account.

Personal Information

When creating a User Account or using the Services, you will provide certain personal information to us (“User Information”).

In addition to any provisions of our Privacy Policy, you agree that we may use your User Information to contact you regarding services we provide.

If you would prefer not to receive marketing or advertising, you must notify us by contacting us at info@mentalboutmax.com and requesting removal from our contact lists.

Mentalboutmax.com uses a third party to process credit card purchases and does not retain any records that include credit card account numbers.

Proprietary Rights

All Training Materials, content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to or included on the Site are protected under applicable copyright, trademark, patent or other proprietary (including but not limited to intellectual property) rights.

The copying, modifying, distributing, transmitting, displaying, selling, licensing, using, publishing or creating derivative works by you of any such matters or any part of the Site, except as expressly allowed by written Agreement, is strictly prohibited.

You do not acquire ownership rights to any Content or other materials viewed through the Site.

The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials.

Prohibited Conduct

User expressly agrees to refrain from doing, either personally or through an agent, any of the following “Prohibited Conduct”:

Misrepresent Your identity or personal information when Accessing the Site; forge any TCP/IP packet header or any part of the header information in any e-mail so that the e-mail appears to be generated by lynda.com.

Post obscene, harassing, defamatory, filthy, violent, pornographic, abusive, threatening, objectionable or illegal material on the Site; post a communication that advocates or encourages criminal conduct or conduct that may give rise to civil liability.

Advertise or otherwise solicit funds, goods or services on the Site.

Provide any commercial hosting service with Access to the Site and/or the content on the Site.

To ensure that Users of the Site do not engage in Prohibited Conduct, mentalboutmax.com reserves the right to monitor use of the Site and reserves the right to revoke or deny Access to the Site to any person or entity whose use of the Site suggests Prohibited Conduct. You agree not to violate any U.K., foreign or international software or technology export laws and regulations, including without limitation the U.K. Export Administration Regulations.

Limitations on LIABILITY. IN NO EVENT SHALL mentalboutmax.com .COM AND/OR ITS AFFILIATES, MEMBERS, agents, employees, LICENSORS OR SUPPLIERS BE LIABLE FOR ANY PUNITIVE, consequential, OR MULTIPLE DAMAGES OR LOST PROFITS OR OTHER SPECIAL, DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING ANY DAMAGES RESULTING FROM LOSS OF BUSINESS ARISING OUT OF OR IN CONNECTION WITH THE Training Materials or related services, EVEN IF mentalboutmax.com .COM HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR IF SUCH DAMAGES WERE FORESEEABLE.

Indemnity. You agree to defend, indemnify and hold harmless mentalboutmax.com , its managers, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

(i) your violation of this Agreement or Privacy Policy;

(ii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or

(iii) any claim that one of your User Submissions caused damage to a third party.

This defence and indemnification obligation will survive termination of this Agreement and your use of the Services.

mentalboutmax.com e-download policy requires all download links and passwords to be used solely by the purchasing party . Mentalboutmax.com highly recommends you burn a backup copy of all Training Materials purchased.
